2. Principles

We comply with the Swiss Federal Act on Data Protection (FADP, revDSG; in force since 1 September 2023) and, where applicable, with the General Data Protection Regulation of the European Union (GDPR). We process personal data exclusively within the legal framework and only to the extent necessary to provide our services.

We only collect the data we actually need. We do not sell data, we do not rent out data, and we do not pass data on to third parties unless described in this policy or required by law.

3. What data we process

3.1 Contact form

If you send us an enquiry via the contact form on this website, we process the following information:

  • Name (required)
  • Organisation (required)
  • Email address (required)
  • Phone number (optional)
  • Your request from the field “What is it about?” (required)

Purpose: Handling your enquiry, preparing a quotation, arranging appointments and other customer communication.
Sending: To deliver your enquiry to info@momentum-impuls.com, we use Twilio SendGrid. The information from the form is transmitted to this service for that purpose.
Legal basis: Initiation or performance of a contract (Art. 31 para. 2 let. a FADP; Art. 6(1)(b) GDPR).
Retention period: The website itself does not store the information; your enquiry is kept as an email in our mailbox. Enquiries that do not lead to an engagement are deleted there after twelve months at the latest. If an engagement is placed, the statutory retention periods apply (Art. 958f CO: ten years for business records).

3.2 Server log files

Each time a page is accessed, the web server stores technical data in log files: your full IP address, the date and time, the address accessed, the status code, the amount of data transferred, the previously visited page (referrer) and your browser and operating system.

From these log files the server compiles access statistics (AWStats), which also contain IP addresses. To ward off attacks, the firewall and the filter for malicious requests additionally log the IP address, the address accessed and the browser.

Purpose: Operation of the website, error diagnosis, protection against attacks.
Legal basis: Overriding legitimate interest in secure operation (Art. 31 para. 1 FADP; Art. 6(1)(f) GDPR).
Retention period: Log files for up to six months, security logs for up to 52 days, followed by automatic deletion. The access statistics are kept for as long as this website is operated. The log files are also contained in the server backups and are deleted together with them.

3.3 Cookies and consent

We manage your consent with the Real Cookie Banner plugin from devowl.io GmbH. It runs on our own web server; no data is transmitted to devowl.io in the process.

The website stores your choice in a necessary cookie (real_cookie_banner*) on your device for 365 days. So that we can demonstrate consent, we also keep a record of consent on the server: a random identifier, your choice, date and time, the page accessed, technical details such as the window size, and your IP address, shortened by the last block and as a checksum. The record is deleted after ten years.

Legal basis: Proof of consent given (Art. 6(1)(c) GDPR; legitimate interest under Art. 31 para. 1 FADP).

You can change your choice via “Cookie settings” in the footer of every page. There you will also find the “Consent history”, and with “Revoke consent” you withdraw all consents. The revocation applies to the future; processing that has already taken place remains unaffected.

3.4 Google Tag Manager and Google Analytics 4

After you have given your consent, we load Google Tag Manager (group “Functional”) and Google Analytics 4 (group “Statistics”), services of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Tag Manager manages the integration of Google Analytics. Via Google Consent Mode, the Google services receive your choice and act accordingly. Google Analytics records page views as well as information on the browser and device used, the referring link and the approximate location.

Google Analytics uses the cookies _ga and _ga_* to distinguish users and to store the session status. The default retention period is two years. Neither Tag Manager nor Google Analytics is loaded before you give your consent.

Purpose: Analysis of website use and improvement of our services.
Legal basis: Your consent (Art. 31 FADP; Art. 6(1)(a) GDPR).
Further information: Google privacy policy.

  • Withdrawal of consent given with effect for the future
  • Complaint to a supervisory authority: in Switzerland to the Federal Data Protection and Information Commissioner (FDPIC), in the EU to the competent national data protection authority

8. Data security

Data is transmitted between your browser and our server in encrypted form (HTTPS/TLS). We take appropriate technical and organisational measures to protect your data against loss, misuse and unauthorised access. These measures are reviewed continuously and adapted to the state of the art.

9. No automated individual decision-making

We do not make decisions that have legal effects on you or affect you in a similarly significant way solely on the basis of automated data processing (no profiling within the meaning of Art. 21 FADP / Art. 22 GDPR).

10. Changes to this privacy policy

We reserve the right to amend this privacy policy as necessary, for example if legal bases change or we introduce new functions. The current version is always available at this address.
